We critically evaluate arguments in a recent Journal of Law, Medicine & Ethics article by Svoboda, Adler, and Van Howe disputing the 2012 affirmative infant male circumcision policy recommendations of the American Academy of Pediatrics. We provide detailed evidence in explaining why the extensive claims by these opponents are not supported by the current strong scientific evidence. We furthermore show why their legal and ethical arguments are contradicted by a reasonable interpretation of current U.S. and international law and ethics. After (...) all considerations are taken into account it would be logical to conclude that failure to recommend male circumcision early in infancy may be viewed as akin to failure to recommend childhood vaccination to parents. In each case, parental consent is required and the intervention is not compulsory. Our evaluation leads us to dismiss the arguments by Svoboda et al. Instead, based on the evidence, infant male circumcision is both ethical and lawful. (shrink)

Movement is crucial to Merleau-Ponty’s effort to comprehend sense, meaning as generated within being. This requires a new concept of movement, not as a dislocation within an already determinate space- or time- frame, but as a deeper, more fundamental change that first engenders space and time as determinate contexts in which movement can follow a sensible course. This poses a novel challenge: conceptualizing determinate space and time as contingently arising from a deeper sort of change, which I call templacement. I (...) address this challenge by turning to the Mexica/Aztecs because the most basic term of their ontology is motion-change, and it is obvious to them that motion-change does not occur in an abstract space-time container. Instead, time-place is woven out of ‘prior’ motion-change. This study leads to a deeper lesson for phenomenology, regarding ‘obvious’ presuppositions about what time and philosophy obviously are – and how these presuppositions go hand in hand.La question du mouvement est cruciale dans l’effort de Merleau-Ponty pour comprendre le sens, la signification telle qu’elle se produit dans l’être. The Oxford World History of Empire. 2 vols. Oxford: Oxford University Press, 2021; xxviii + 552 pp.; xxxiv + 1,318 pp.The volumes under review are an impressive if unequal diptych. The first, the slimmer of the two, entitled "The Imperial Experience," comprises a series of analytical studies on the creation, management, and (...) ideologies of empires, and forms of resistance to them. The second, "The History of Empires," is a forbidding tome of forty-four specific studies of individual empires and imperial ventures, from Ur III and Middle Kingdom Egypt to the Mongols and the British, ending, naturally, with America's "global imperium." In the analytics, the usual suspects, including Michael Doyle, Frederick Cooper and Jane Burbank, are on display; and the conceptual approaches of Michael Mann and Ernest Gellner are favorite points d'appui. For premodern empires, the ideas of the Maghribi thinker Ibn Khaldūn provide a different focus, so it is heartening to see Bang and others applying them more consistently (e.g., 1:13, 40, 326–9; 2:162, 246–8, 253). Especially for premodern empires, these volumes can be seen as an extension of earlier handbooks devoted to the state, one devoted to the ancient Near Eastern and Mediterranean state and another on ancient empires.1 As an aspect of world history, the endeavor is the culmination of a decades-long project on the history of empires fronted by Peter Bang.2 He has usefully produced detailed historical introductions not only to both volumes, but also to the subsections in each of them. Perhaps not surprisingly, empire turns out to be a virile enterprise. As Ian Morris notes, "the story of empire... is so strongly gendered that it [End Page 505] seems reasonable to call rulers and commanders 'he' throughout" (1:162 n. 14). The muscular subject is mirrored by its principal actors and by its students. All the editors are men. Reflecting the same balance, out of the forty-five authors of individual studies in the large history of empires volume, there are five (lonely) female voices. In both volumes, women as subjects of empire are, for all intents and purposes, absent.3From the perspective of an historian who has actually worked on the history of an empire, it must be plainly stated that almost all of the theories, adequately reviewed by Bang (1:20–48), are worth about as much as the paper or pixilated screens on which they have been written. Obvious and serious exceptions to every one of the definitions and hypotheticals abound. In fact, a fair number of the exemplary histories in the second volume do not obey the strictures of most of the theories advanced in the first. So it is with a sense of relief that one turns from theory to the hard quantities offered by Walter Scheidel (1:chap. 2). To a considerable degree, his analysis depends on the well-known measurements made by Rein Taagepera. Rather alarmingly, Taagepera counted as an empire "any large sovereign political entity whose components are not sovereign," say, like the well-known empires of Algeria, Finland, or Canada.4 What an analysis of these global entities confirms is that size or orders of magnitude mattered, and that the first entities to count as empires emerged in the 7th to 5th centuries bce in southwestern Asia (1:53; 2:161, 245). The neo-Assyrian empire was the first super-large territorial state and its successor, the Achaemenid empire, was the first "hyper-power without rival" (1:172; 2:83, 111, 161). Subsequent premodern empires were able to reach higher levels of millions of square kilometers of territory and larger populations of dozens of millions of subjects nominally under their aegis. The magnitudes reached by a given generation of super-states set base-lines above which a successor might be able to reach greater sophistication of rule, numbers of subjects, and extent of territory. Husserl's phenomenology has often been criticized for its Cartesian, fundamentalistic, idealistic and solipsistic nature. Today, this widespread interpretation must be regarded as being outdated, since it gives but a very partial and limited picture of Husserl's thinking. The continuing publication of Husserl's research manuscripts has disclosed analyses which have made it necessary to revise and modify a number of standard readings. This anthology documents the recent development in Husserl research. It contains contributions from a number of young phenomenologists, who have (...) all defended their dissertation on Husserl in the nineties, and it presents a new type of interpretation which emphasizes the dimensions of facticity, passivity, alterity and ethics in Husserl's thinking. Background : researchers and sponsors increasingly confront the issue of whether participants in a clinical trial should have post-trial access (PTA) to the trial drug. Legislation and guidelines are inconsistent, ambiguous or silent about many aspects of PTA. Recent research highlights the potential importance of systematic reviews (SRs) of reason-based literatures in informing decision-making in medicine, medical research and health policy. Purpose: to systematically review reasons why drug trial participants should, or need not be ensured PTA to the trial drug (...) and the uses of such reasons. Data sources: databases in science/medicine, law and ethics, thesis databases, bibliographies, research ethics books and included publications’ notes/bibliographies. Publication selection: a publication was included if it included a reason as above. See article for detailed inclusion conditions. Data extraction and analysis: two reviewers extracted and analyzed data on publications and reasons. Results: of 2060 publications identified, 75 were included. These mentioned reasons based on morality, legality, interests/incentives, or practicality, comprising 36 broad (235 narrow) types of reason. None of the included publications, which included informal reviews and reports by official bodies, mentioned more than 22 broad (59 narrow) types. For many reasons, publications differed about the reason’s interpretation, implications and/or persuasiveness. Publications differed also regarding costs, feasibility and legality of PTA. Limitations: reason types could be applied differently. The quality of reasons was not measured. Conclusion: this review captured a greater variety of reasons and of their uses than any included publication. Decisions based on informal reviews or sub-sets of literature are likely to be biased. Research is needed on PTA ethics, costs, feasibility and legality and on assessing the quality of reason-based literature. (shrink)

I start with a detailed but partial analysis of a case regarding grade inflation. The case is inspired by the discussion in Crumbley et al. (2010) and its elaboration in Roberts (2016). I supplement the case description by introducing certain facts that are not in the original discussion. The subsequent analysis is based on this enriched case description. I then raise a number of objections against my analysis. An important metaethical, methodological question emerges while responding to these objections. To what (...) extent are characterizations of moral situations and their descriptions independent from moral commitments? Is there a neutral concept of moral relevance? I argue that we do not have a theory-neutral concept of moral relevance, and that case descriptions essentially presuppose moral commitments. From my moral perspective, as this perspective is reflected in the enriched case description I utilize, the original case description of grade inflation already involves utilizing the wrong moral perspective or theory. Many psychological studies of categorization and reasoning use undergraduates to make claims about human conceptualization. Generalizability of findings to other populations is often assumed but rarely tested. Even when comparative studies are conducted, it may be challenging to interpret differences. As a partial remedy, in the present studies we adopt a 'triangulation strategy' to evaluate the ways expertise and culturally different belief systems can lead to different ways of conceptualizing the biological world. We use three groups (US bird experts, US (...) undergraduates, and ordinary Itza' Maya) and two sets of birds (North American and Central American). Categorization tasks show considerable similarity among the three groups' taxonomic sorts, but also systematic differences. Notably, US expert categorization is more similar to Itza' than to US novice categorization. The differences are magnified on inductive reasoning tasks where only undergraduates show patterns of judgment that are largely consistent with current models of category-based taxonomic inference. The Maya commonly employ causal and ecological reasoning rather than taxonomic reasoning. Experts use a mixture of strategies (including causal and ecological reasoning), only some of which current models explain. US and Itza' informants differed markedly when reasoning about passerines (songbirds), reflecting the somewhat different role that songbirds play in the two cultures. The results call into question the importance of similarity-based notions of typicality and central tendency in natural categorization and reasoning. These findings also show that relative expertise leads to a convergence of thought that transcends cultural boundaries and shared experiences. (shrink)

The possible role of the neurotransmitter serotonin in human affiliative behavior is under-examined in the review by Depue & Morrone-Strupinsky (D&M-S). This commentary reviews evidence indicating that serotonin not only inhibits aggressive behavior that may be detrimental to affiliative bonds with others in a social group but serotonin also enhances prosocial behaviors that may facilitate ties to the social group.

Health professionals faced with refusal of life-saving treatment may wish to override a person's wishes, especially if that person suffers from a mental disorder. Mental illness does not automatically mean a patient is incapable of making decisions of this nature. It is not always clear whether an individual is legally competent to decide whether to undergo treatment or not. This article discusses a clinical example and analyses some of the moral implications.

The field of psychology, including cognitive science, is vexed by a crisis of confidence. Although the causes and solutions are varied, we focus here on a common logical problem in inference. The default mode of inference is significance testing, which has a free lunch property where researchers need not make detailed assumptions about the alternative to test the null hypothesis. We present the argument that there is no free lunch; that is, valid testing requires that researchers test the null against (...) a well-specified alternative. We show how this requirement follows from the basic tenets of conventional and Bayesian probability. Moreover, we show in both the conventional and Bayesian framework that not specifying the alternative may lead to rejections of the null hypothesis with scant evidence. We review both frequentist and Bayesian approaches to specifying alternatives, and we show how such specifications improve inference. The field of cognitive science will benefit because consideration of reasonable alternatives will undoubtedly sharpen the intellectual underpinnings of research. (shrink)
